CONTRACT FOR SERVICE
This contract for service is made and effective for the rental duration according to the booking, BETWEEN: SHENG HONG SPEED7 PTE LTD, UEN: 202100181Z (the "Company"), a corporation organised and existing under the laws of the Singapore, with its office located at: 18 SIN MING LANE #01-13 MIDVIEW CITY S(573960), AND the Hirer.

NOW, THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth, the parties hereto agree as follows:
1. VEHICLE
The Company hereby handover to the Hirer, and the hirer hereby takes over from The Company, the described Motorcar according to the booking information (the “Vehicle”):
2. TERM
The term of this Contract shall commence according to the rental duration.
3. JOB FULFILMENT
The Hirer shall pay the rental fee to The Company according to the booking information.
4. USE
Only the mention hirer can use the vehicle and shall use the Vehicle in a careful and proper manner and shall comply with the conform to all national, state, municipal, police and other laws, ordinances and regulations in any way relating to the possession, use or maintenance of the Vehicle.
5. PAYMENT TERMS
Payments will be collected through the iDrive.SG platform.
6. SECURITY DEPOSITS
Security deposits will be collected through the iDrive.SG platform.
7. REPAIRS:
The hirer shall keep the Vehicle in good repair, condition and working order and shall furnish any and all parts, mechanisms and devices required to keep the Vehicle in good mechanical working order. (Payment for wear and tear will be liable by The Company)
8. INSURANCE
a) The Hirer will be responsible for the full amount of the excess not exceeding SGD$3000 for own damages and SGD$3000 for third party claims upon reporting of the accident. Windscreen excess at SGD$150.
b) For travelling to Malaysia, The Hirer will be responsible for the full amount of the excess not exceeding SGD$6000 for own damages and SGD$6000 for third party claims upon reporting of the accident. Windscreen excess at SGD$300. This policy provides cover for any accident, loss, damage, injury or legal responsibility.
c) Hirer who is holding a license less than a year, will be responsible for the full amount of excess not exceeding SGD$6000 for own damages and SGD$6000 for third party claims upon reporting of the accident. Windscreen excess at SGD$300.
d) For travels to Malaysia, The Hirer with license less than a year will be responsible for full amount of the excess not exceeding SGD$12000 for own damages and SGD$12000 for third party claims upon reporting of the accident. Windscreen excess at SGD$600.
This policy provides cover for any accident, loss, damage, injury or legal responsibility arising within the following geographic areas:
i. West Malaysia
ii. Part of Thailand within 80km from the border of West Malaysia.
e) Only the mentioned or named Hirer stated in this contract will be covered by the company insurance.
f) It is by law that each and every accident if there is bodily injury, or an accident involving a government vehicle, a foreign vehicle or damaged to government property, hirer must report to Singapore Traffic Police within 24 hours and original copy of the accident report must be forwarded to the Company’s office as soon as possible.
g) Additional excess of SGD$8000 for any driver 21 years old or with minimum 1 year driving experience.
h) Additional excess of SGD$16000 for driver below 21 years old or with less than 1 year driving experience (P Plate).
- In the event of an accident, the hirer shall:
- Obtain vehicle registration numbers, photographs, names and addresses of the parties involved and of witness;
- Not admit fault or liability;
- Not abandoning the Vehicle without adequate provision for safeguarding and
securing the same; and Notify the Company immediately
9. MALAYSIA USAGE
In the event of any breakdown of vehicle outside the Republic of Singapore, it is the Hirer’s sole responsibility to tow back the vehicle to the Republic of Singapore at the Hirer’s cost. All Malaysia usage is at Hirer’s own risk.
10. LOSS AND DAMAGE
a) The Hirer hereby assumes and shall bear the entire risk of loss, theft, destruction and damage to the Vehicle from any and every cause or whatsoever, whether or not covered by insurance except for natural disaster involved. No loss or damage to the Vehicle or any part thereof shall impair any obligation of the hirer under this Contract which shall continue in Full force and effect through the term of the Contract.
b) In the event of loss or damage of any kind whatever to the Contract, The Hirer shall, at The Company’s option:
- Place the same in good repair, condition and working order; or
- Replace the same with like Vehicle in good repair, condition and working order; or
- Pay to The Company the replacement cost of the Vehicle.
11. SURRENDER
Upon the expiration or earlier termination of the Contract, the hirer shall inform the Company One week in advance and return the Vehicle to The Company in good repair, condition and working order, ordinary wear and tear resulting from proper use thereof alone excepted, by deliver the Vehicle at hirer’s cost and expenses to such place as The Company shall specify within the city or country in which the same was delivered to the hirer.
12. FILING
The Hirer, on request, agrees to execute any instrument necessary to the filing and recording of the Contract agreement or the Vehicle. Hirer further appoints The Company its true and lawful attorney to prepare, execute, and sign any and all security agreements, financing statements, or otherwise, in order to effectuate a lien on the property subject to this Contract, and to sign the name of the hirer with the same force and effect as if signed by the hirer, and to file such instruments at the proper location or locations.
13. LOCATION AND MAINTENANCE
At Hirer’s own risk, hirer shall use or permit the use of the vehicle solely at location specified in this Contract, or if none is specified, at hirer’s billing address set forth above and such vehicle shall not be moved without The Company’s prior written consent. The hirer, at hirer’s expense, shall maintain the vehicle in good repair, condition and functional order, shall not use the vehicle unlawfully, and shall not alter the vehicle. The Company shall not be liable for loss of profit or other consequential damages resulting from the theft, destruction, or disrepair of the vehicle and there shall be no abatement of Contract payments on account of any such theft, destruction, or disrepair.
14. VEHICLE SERVICING
At no circumstances should the hirer drives the car exceeding the mileage/date mentioned on the vehicle servicing label on the windscreen. The hirer is liable to a penalty of SGD$500 in the event.
15. TITLE & PERSONAL PROPERTY
The Vehicle is, and shall at all times remain, property of The Company, and The hirer shall have no right, little, or interest except as expressly set forth in this Contract. The Vehicle is and shall at all times be and remain personal property although the vehicle or any part of it may now be or hereafter become in any manner affixed or attached to real property or any improvements. All additions or improvements to the vehicle or any kind or nature made by the hirer shall become component parts of the vehicle and title shall immediately vest in the Company and be governed by the terms of this Contract.
16. INDEMNITY
The hirer shall indemnify The Company against, and hold The Company harmless rom, any and all claims, actions, suits, proceedings, costs, expenses, damages and liabilities, including reasonable attorney’s fees and costs, arising out of, connected with, or resulting from The hirer’s use of the Vehicle, including without limitation the manufacture, selection, delivery, possession, use, or return of the vehicle.
17. DEFAULT
If the hirer fails to fulfil provided within Three (03) days after the sum is due and payable, or if The hirer fails to observe, keep or perform any other provision of this Contract required to be observed, kept or performed by The hirer, The Company shall have the right to exercise any one or more of the following remedies:
a) Late payment fee at SGD$60 per day
b) To declare the entire amount of rent hereunder immediately due and payable without notice or demand to hirer
c) To sue for and recover all rents, and other payments, then accrued or thereafter accruing.
d) To take possession of the Vehicle, without demand and notice, wherever same may be located, without any court order or other process or law. The hirer shall be liable to any and all damages occasioned by such taking of possession, and car towing fee of SGD$500.
e) To terminate this contract.
f) To pursue any other remedy at law or in equity.
g) To recover whatever amount due to the company from any security deposit held by the company.
Notwithstanding any repossession or any other action which The Company may take, The hirer shall be and remain liable for the full performance of all obligations on the part of the hirer to be performed under this Contract. All the Company’s remedies are cumulative, and may be exercised concurrently or separately.
18. BANKRUPTCY
Neither this Contract nor any interest therein is assignable or transferable by operation of law. If any proceeding under this Bankruptcy Act, as amended, is commenced by or against the Hirer, or if the Hirer is adjudged insolvent, or if Hirer makes any assignment for the benefit of his creditors, or if a write of attachment or execution is levied on the Vehicle is not recontract or satisfied within ten (10) days thereafter, or if a receiver is appointed in any proceeding or action to which the Hirer is a party with authority to take possession or control of the Vehicle, The Company shall have and may exercise any one or more of the remedies set forth in Section 14 hereof; and this Contract shall, at the option of The Company, without notice, immediately terminate and shall not be treated as an asset of The hirer after the exercise of said option.
19. OWNERSHIP
The Vehicle is, and shall at all times be and remain, the sole and exclusive property of The Company; and The Hirer shall have no right, title or interest therein or thereto except as expressly set forth in this Contract.
20. NOTICES
Service of all notices under this Agreement shall be sufficient if given personally or mailed certified, return receipt requested, postage prepaid, at the address hereinafter set forth, or to such address as such party may provide in writing from time to time.

21. GOVERNING LAW
This contract shall be construed and enforced according to laws of the State of SINGAPORE.
22. HEADINGS
Headings used in this Contract are provided for convenience only and shall not be used to construe meaning or intent.
23. TRAFFIC OFFENCE & SUMMONS
The Hirer shall by fully liable for all traffic offenses and summons made under the vehicle during the validity of this contract. Traffic and Summon fines will be deducted from the security deposit.
24. RETURNING/COLLECTION OF VEHICLE
Collection of vehicle is from 1pm to 3pm, Monday to Friday, or at company discretion. The timing of returning the vehicle is strictly from 10am to 12pm only, Monday to Friday. Closed on Saturdays, Sundays and PH. There will be a SGD $10/Hr penalty charge for late return, maximum 3 hours. Any vehicle to return after 5pm will be charged as a full day rental.
25. RESPONSIBILTY
This contract is strictly between the Hirer 1/Hirer 2 and SHENG HONG SPEED7 PTE LTD ONLY. Under no circumstances should the Hirer 1/Hirer 2 be waived of his responsibility set in this contract.

27. BREACH OF CONTRACT
In the event of a breach of this contract, hirer will be liable for a payment equivalent for the remaining unfulfilled rental period stated in the contract.
28. ENTIRE AGREEMENT
This instrument constitutes the entire agreement between The Company and The Hirer and is irrevocable for its terms and for the aggregate rentals reserved above, and it shall not be amended, altered, or changed except by written signed by parties. The Hirer shall provide The Company with such corporate resolutions, opinions of counsel, financial statements, and other documents as The Company shall request from time to time. If more than one Hirer is named in this Contract the liability shall be joint and several. Time of the essence of this Contract. Any failure of The Company to require such strict performance by The Hirer or any waiver by The Company of any provision of The Contract shall not be construed as a consent or waiver of any other breach of the same or any other provision. If any portion of this Contract is deemed to be invalid, it shall not affect the rest of this agreement. The Hirer applies to The Company for a Contract of the above-described property for commercial purposes and agrees that this Contract is not to be construed as a consumer contract. If The Company accepts by executing the Contract below, The Hirer agrees to rent from The Company and The Company agrees to rent to The Hirer, the vehicle, on all of the terms and conditions of this Contract.
