TERMS AND CONDITIONS
MV Auto, The Company, hereby agrees to let the Hirer take on the hire of the said motor vehicle subject to the following terms and conditions:
1. Rates quoted are in Singapore Dollars, covering a full 24-hour unlimited mileage rental, maintenance, insurance and a 24- hour breakdown service.
2 The Hirer must be over 22 and below 70 years of age, possess a valid Singapore Class 3 or International driving license of permit, held for at least two years.
3. A deposit equivalent to one month's rental and rental fee for the period of hire is payable before commencement of the rental.
4. The hiring shall commence on the date the time specified in the rental agreement and shall continue for the period and end on the date and at the time therein stated, unless extended as expressly requested by the Hirer.
5. If for any reason the vehicle ordered by the Hirer is not available, The Company shall have the right to replace the said vehicle with an alternative vehicle of similar seating capacity and performance. If no such alternative vehicle is available or if the Company shall decline to provide an alternative Vehicle, then the Hirer shall be repaid any hire charge and deposit (if any) after offsetting the rental charge and costs incurred, but shall have no other claim of any kind whatsoever against the Company. If no deposit is paid, the Hirer must pay for rental charges incurred on demand.
6. The vehicle may only be driven by the Hirer or by persons who have been registered in the rental agreement. It is expressly forbidden to rent the vehicle out to third persons or permit the Vehicle to be used for the purposes that conflict with the law. The Hirer shall indemnify the Company for the value of the Vehicle and bear all costs incurred should the Vehicle be seized, confiscated or forfeited.
7. The Hirer shall be liable for late payment at a daily interest rate of 1.5% per month of any sum owed to the Company in accordance with the provisions of this Agreement. Such interest shall accrue for the agreed date of the return of the said vehicle by the Hirer to the Company, regardless of whether the Hirer in fact returns the said Vehicle. If Debt collection services are needed, all fees are to be borne by hirer 20% of total amount owing. Repossession of Vehicle is $800.
8. In case of an accident with the Vehicle during the Hirer's use, the Hirer undertakes to do the following:
obtain the names, identity card numbers and addresses of all parties involved and / or witnesses; pictures of the damages, if any, as well as the on-site scenario of all parties' Vehicles;
not admitting liability or guilt; not abandoning the Vehicle without adequate provisions for safeguarding and securing the same; notify the police immediately if injuries are involved;
notify the Company within 24 hours of the occurrence of the accident; cooperate fully with The Company's investigation of the accident or incident; deliver to The Company at such applicable address every process, pleading or paper relating to any claims, suits or proceedings arising from such accident. In the event of a claim, suit or legal proceeding, The Hirer shall cooperate fully with the Company and its representatives;
9. The Company shall not under any circumstances be liable to make payment to The Hirer to indemnify the Hirer against any loss, injury or damage sustained by the Hirer or by any third party as a result of use of the said Vehicle.
10. MV Auto provides "Third Party Coverage" under Tokio Marine Insurance Group. Section II Excess are S$2,500 for any accidents arising due the negligence or other reasons caused by the Hirer. Additional excess of S$1,500(on top of the $2,500 basic excess) will be levied on drivers aged 23 to 26 years old, elderly or inexperienced drivers. 11. Own damage assessment
• Depending on assessment of damages, an invoice will be provided and payable to MV auto.
12. All vehicles are strictly for Singapore & West Malaysia use only. If MV Auto is not notified before the hired Vehicle enters Malaysia, the Hirer will be fully responsible for all first and third party liability damages, fire or theft and all other liquidating damages arising in West Malaysia. Section II Excess is $3500 for Third Party.
13. Prior to the end of rental expiration period or upon demand by The Company, the Hirer shall return the vehicle to MV Auto in the same condition as received by the Hirer. Failing which, The Company shall be entitled to repair the Vehicle and the cost thereof shall be recoverable from the Hirer.
14. The Hirer will be responsible for all ERP charges, all parking, traffic fees and fines incurred. The Hirer is responsible for all parking and traffic violations that may be incurred and shall answer all Police and Traffic Court Summonses, Notices and lnquiries in connection herewith.
15 The Hirer shall pay for the cost of petrol during the period of hiring. The Hirer shall return said vehicle with a refilled tank of petrol, failing which would entail a petrol charge to the Hirer.
16. The Hirer shall be deemed to have extended the period of hire by reason of the Hirer's failure to return the said vehicle. The Hirer shall also be bound by these terms and conditions in respect of any replacement vehicle provided.
17. The Company shall not be liable for any repair or miscellaneous charges incurred at any external workshop without prior authorisation.
18. The Company shall not be liable to the Hirer or any persons for any alleged lost article, loss or damage, whatsoever and howsoever caused by reason of the Company resuming possession of the vehicle.
19. In the breach of the terms and conditions of the Agreement, The Company reserves the right to resume possession of the hired Vehicle at any time in The Company's interest without prejudice.
